NCLAT Overturns NCLT Order, Allows JC World Hospitality Promoters to Bid
Imagine a company called JC World Hospitality was in trouble and needed a plan to get back on its feet.
The people who originally owned and ran the company wanted to propose a plan.
However, a court called the NCLT said they couldn't because of some rules about who is allowed to make a plan.
This court even canceled their proposed plan.
The owners disagreed and went to a higher court, the NCLAT.
The NCLAT looked at the case and said the NCLT was wrong.
They explained that the owners actually met all the requirements, including having enough money.
The NCLAT also noted that another government department had already said the owners were okay to participate.
Because of this, the NCLAT canceled the NCLT's decision and told the NCLT to reconsider the owners' plan quickly, within three months.
This means the original owners might get to present their plan after all.
NCLAT set aside an NCLT order disqualifying JC World Hospitality promoters from submitting a resolution plan.
The appellate tribunal found the NCLT's decision to be 'perverse' and 'unsustainable'.
NCLAT stated that the promoters met the required ₹50 crore net worth eligibility criterion.
The tribunal also cited an MCA email removing promoter disqualification effective from earlier dates.
NCLAT revived the promoters' application before the NCLT for a decision within three months.
