MP High Court Recalls Ex-Parte Order
The Madhya Pradesh High Court recently made a decision about the responsibilities of lawyers and the people they represent in court.
The court said that when someone hires a lawyer, they should be able to trust that the lawyer will represent them in court when needed.
The court made this decision while looking at a case about a family dispute over property.
In this case, the people involved said their lawyer did not tell them about a court hearing, so the court had to make a decision without them.
The court then decided to reconsider this decision because the lawyer did not do their job properly.
The court also said that people who hire lawyers do not have to check up on their lawyer every day to make sure they are doing their job.
The Madhya Pradesh High Court recalled an ex-parte order in a family dispute case.
The court held that litigants should be able to trust their counsel to represent them.
The litigants claimed their counsel did not inform them about the hearing.
The court stated that litigants are not responsible for acting as their lawyer's watchdog.
The case involved a declaration of title and partition of property.
