Meta Challenges NCLAT Order on WhatsApp Data Sharing
Meta and WhatsApp are going to the Supreme Court because they disagree with a decision that made them pay a big fine.
The fine was given because they shared user data with other companies in the Meta group without giving users a choice.
The court said they can't share this data for five years, but Meta and WhatsApp think this is unfair and could hurt their free service.
They also think the fine is too much.
The problem started when WhatsApp changed its privacy rules in 2021, and the regulators said this was not fair to users.
Meta and WhatsApp challenged the NCLAT order upholding CCI's Rs 213.14 crore penalty for data sharing.
NCLAT retained the penalty but struck down CCI's finding of abuse of dominance in the messaging market.
CCI had prohibited data sharing with Meta group entities for five years and mandated disclosure of data collection purposes.
The dispute originated from WhatsApp's 2021 privacy policy update mandating data sharing with Meta.
NCLAT had earlier granted interim relief staying the five-year data-sharing ban.
