Bombay HC Criticizes BMC for 1,526-Day Revenue Appeal Delay
The Bombay High Court was very upset with the Brihanmumbai Municipal Corporation (BMC) for taking too long to file an appeal about a property's tax value.
The BMC had 30 days to file the appeal, but they took over 1,500 days.
The court said the BMC, which is the richest city government in India, should make decisions quickly, not slowly like a bureaucracy.
The BMC tried to say they were short on staff and that COVID-19 caused delays, but the court didn't accept these excuses.
The court had to dismiss the appeal, which means the BMC might lose some money they thought they were owed.
The judge said the BMC needs to fix its systems so this doesn't happen again.
The Bombay High Court dismissed the BMC's revenue appeal due to a 1,526-day delay in filing.
The appeal related to the rateable value of a property owned by Ashirwad Shelters Pvt Ltd, which determines the property tax payable to the BMC.
The BMC was required to file the appeal within 30 days but convened meetings and filed the appeal much later.
The court rejected the BMC's excuses, including staff shortages and COVID-19 disruptions, as the delay started before the pandemic.
The court urged the BMC to strengthen its systems to prevent such delays in the future.
