Delhi Court Overturns Arbitrator’s Decision on Railway Deposit
Carzonrent rented a space at a big train station in 2011 to run radio taxis.
When the contract ended, they wanted their security deposit back.
The railway company said Carzonrent had to pay service tax first, but Carzonrent said the contract didn’t require that.
A judge in Delhi looked at the case and said the earlier arbitrator’s decision was wrong because the time limit hadn’t actually passed.
So the judge overturned the arbitrator’s ruling and let Carzonrent try again to get their money back.
The case is still being worked on, and the parties can go to arbitration again if needed.
Delhi court set aside arbitrator’s July 2022 decision rejecting Carzonrent’s claim for a Rs 15 lakh deposit refund.
The dispute stemmed from a 2011 contract for radio taxi services at Hazrat Nizamuddin Railway Station.
Northern Railway withheld the deposit, insisting Carzonrent pay service tax, which the company argued was not contractually required.
Judge Pulastya Pramachala found negotiations continued until May 2019, making the arbitration filed within the limitation period.
The court deemed the arbitrator’s time‑bar ruling perverse and allowed further arbitration on the remaining issues.
