IBBI Streamlines Corporate Insolvency Process with Amendments
The IBBI (a group in India that deals with bankrupt companies) made some changes to how they handle companies that can't pay their debts.
They're trying to make the process faster and fairer.
Now, companies can be sold off in parts to help save them.
Also, people who lend money to these companies will get paid back in a specific order.
Lenders who didn't agree with the plan to save the company will be paid before those who did.
The changes also let lenders watch meetings about the company's finances to help them make better decisions.
And, professionals now have to show all plans they receive to a group that decides what to do with the company.
IBBI amended regulations for corporate insolvency on May 26, 2025.
Resolution professionals can invite expressions of interest for the entire company or individual assets.
Financial creditors who didn't support a resolution plan will receive payments before those who did.
Committee of Creditors (CoC) can allow interim finance providers to observe meetings.
Resolution professionals must present all plans, including non-compliant ones, to the CoC.
