Delhi HC Allows NHAI to Terminate Contractor for Expressway Delay
The Delhi High Court has allowed the National Highways Authority of India (NHAI) to terminate the contract of a company called Roadways Solutions India Infra Limited (RSIIL).
This company was supposed to build a part of the Delhi-Mumbai Expressway, but they didn't finish an 87-kilometer stretch in Gujarat.
The court said that the expressway is important for people to travel smoothly, and delays are not good for the country.
The court also said that NHAI can ask for new bids to finish the project if they think it's urgent.
Both NHAI and RSIIL are already in a dispute, and the court said it's up to them to decide who is at fault.
The court also allowed NHAI to keep the money RSIIL had promised as a guarantee, but they can't use it until the dispute is settled.
Delhi High Court permits NHAI to terminate the contract of RSIIL for delaying the Delhi-Mumbai Expressway project.
RSIIL failed to complete an 87-km stretch in Gujarat, causing delays in the project.
The court restrained NHAI from encashing the bank guarantees and surety bonds submitted by RSIIL, amounting to approximately Rs 100 crore.
NHAI and RSIIL are engaged in arbitration proceedings, and the court said it's up to them to decide who is at fault.
The court overturned a single judge's order that had restrained NHAI from acting on notices against RSIIL.
