Telangana High Court Dismisses Writ on Reservations
The Telangana High Court recently made important decisions about local elections.
A group called Telangana BC Sankshema Sangam filed a petition challenging the state government's decision to reduce special seats for a group of people called Backward Class (BC) in village council elections.
The court dismissed this petition, saying it was not the right way to challenge the government's decision.
The court also rejected other petitions that argued the government was using old data to decide who gets these special seats.
The court said it couldn't change the election rules once the elections had already started, but it noted that the government should have updated the data before setting the election schedule.
The court also said that if no one runs for the special seats, new elections will be held later.
The Telangana High Court dismissed a writ challenging the state government's decision to reduce Backward Class (BC) reservations in gram panchayat elections from 24 to 17 per cent.
The court expressed disapproval of the petitioners' decision to invoke a writ of quo warranto against district collectors, questioning the authority of the petitioners to challenge the collectors' posts.
The petitioners argued that the reduction of BC reservations was done hastily and without proper justification, and that the state failed to file counter-affidavits in related matters.
The State Election Commission (SEC) submitted that judicial intervention would disrupt the election process and the 50 per cent reservation ceiling.
The court observed that the issues raised by the petitioners were substantial and stemmed from administrative lapses in updating demographic data for reservations.
