HC: Poverty Should Not Be Linked to Criminality When Granting Bail
The Punjab and Haryana High Court said it's wrong to assume that people from poor backgrounds are criminals.
The court was deciding if a young person accused of a drug crime should be let out of jail while the case goes on.
Lower courts had said no to bail because the young person lived in a slum.
The High Court disagreed.
The High Court explained that being poor or having a tough life shouldn't mean someone is automatically seen as guilty.
They also said the young person had been in jail for a long time, and keeping them there longer wouldn't be fair, especially since the aunt had already been released on bail.
The court granted bail, stating the juvenile deserves a chance to reform and reintegrate into society.
Punjab and Haryana High Court criticized the stereotyping of individuals from socio-economically deprived backgrounds.
The court granted bail to a juvenile charged under the NDPS Act, overturning lower court decisions.
The juvenile was arrested in May 2023, with 39.73 kg of ganja recovered.
The High Court rejected the lower courts' reasoning that poverty or humble origins indicated criminal propensity.
The court cited the juvenile's prolonged custody and the aunt's bail as reasons for granting bail.
