NCLAT Rejects Insolvency Plea Against Voltas
A company called Air Wave Technocrafts tried to start insolvency proceedings against Voltas, a Tata Group company, because Voltas didn't pay them for services.
The National Company Law Tribunal (NCLT) in Mumbai rejected this request in May 2025, saying there was already a dispute between the two companies.
Air Wave Technocrafts then appealed to a higher tribunal, the NCLAT, but the NCLAT also rejected the appeal, agreeing with the NCLT that there were ongoing disputes about the work and payments.
The NCLAT said there was no mistake in the NCLT's decision and dismissed the appeal.
Air Wave Technocrafts claimed they were owed ₹1.20 crore, but Voltas disputed this and said the amounts needed commercial verification.
NCLAT rejected an insolvency plea against Voltas, upholding the NCLT's earlier decision.
The NCLT had rejected the petition due to a pre-existing dispute over work certification, amounts, and documentation.
Air Wave Technocrafts, an operational creditor, claimed a debt of ₹1.20 crore from Voltas for services rendered.
Voltas disputed the outstanding liability and raised issues of limitation.
NCLAT found no merit in the appeal and dismissed it, agreeing with the NCLT's findings.
