Supreme Court Strikes Down 2021 Environmental Memorandum
The Supreme Court of India decided that a 2021 government memo that let projects get environmental approval after they had already started was illegal.
The court said that only projects that are very important for the public can get such late approvals, and only if the government says so.
Before this decision, more than 150 big projects had been given these late approvals, which broke environmental rules.
The court wants to make sure that future projects get proper environmental checks before they start.
It also says that the government should not use these late approvals as a normal practice, and companies should plan their projects so they do not harm the environment.
Supreme Court invalidated the 2021 Office Memorandum that permitted retrospective environmental approvals.
The judgment allows ex post facto approvals only for projects of public interest via statutory notifications.
More than 150 projects had received retrospective clearances by November 2025, violating the Environment (Protection) Act.
The decision balances the need for environmental impact assessments with limited exceptions for the public good.
The ruling urges the government to avoid routine retrospective approvals and encourages industry to align projects with nature.
