Supreme Court Bars High Court Judge From Hearing Former Client Cases
The Supreme Court of India said that a judge in a lower court should not decide a case if that judge used to be the lawyer for the company in the same case.
The decision came after a company called Prateek Resorts and Builders Private Limited asked the Supreme Court to look at orders made by a judge in Uttarakhand.
That judge had helped the company in a 2013 case about the same piece of land.
The Supreme Court said judges must look like they are doing the right thing, not just do it.
They also said the judge had added new questions to the case that were not part of the original ones.
This rule helps keep the courts fair and honest.
Supreme Court ruled High Court judges must not hear cases involving former clients on the same subject matter.
Decision was made while reviewing special leave petitions from Prateek Resorts and Builders Private Limited.
The Uttarakhand High Court judge had previously represented the company in a 2013 writ petition over the same land parcel.
Bench emphasized that justice must be seen to be done and judges should avoid conflicts of interest.
Court criticized the judge for expanding the scope of writ petitions beyond their original issues.
