Telangana HC: Title Disputes No Bar to Building Permissions
The Telangana High Court has said that the city's municipal body, GHMC, does not need to solve complicated land ownership disputes before giving permission to build on a property.
The court made this decision while dismissing a complaint by some people who said that others were building on their land without permission.
The court said that the GHMC only needs to check if the person asking for permission seems to have a right to the land, not solve the whole dispute.
The people who complained had land in Old Alwal village and said that the GHMC did not stop the illegal building on their land even after they complained many times.
Telangana High Court dismissed a writ petition challenging building permissions granted by GHMC.
Court ruled that municipal authorities do not need to resolve title disputes before granting building permits.
Petitioners claimed illegal constructions were carried out on their 13.22 acres land in Old Alwal village.
Petitioners alleged GHMC failed to act on their representations made between 2013 and 2017.
Court clarified that municipal commissioner only needs to consider prima facie title and possession for granting permits.
