Gurgaon Court Convicts Former IREO CEO Sanka of Cheating in Fake Prescription Case
Imagine someone needed to go to court but didn't want to.
They got a doctor's note saying they were sick, but the information used to get the note was made up.
The court found out about this.
Even though the doctor who signed the note didn't know it was fake and was tricked, the people who made up the information were found guilty of cheating and planning to deceive.
They were also found guilty of getting rid of evidence.
However, they were not found guilty of actually creating a fake document because the doctor did sign it, thinking the story was true.
The court said this was a serious abuse of the legal system and gave them jail time and fines to make sure people don't try to trick the courts.
Former IREO CEO Ramesh Sanka and Meenu Sharma convicted of cheating, criminal conspiracy, and destruction of evidence.
They were acquitted of forgery charges related to a fake medical prescription case.
The case involved using a questionable medical document to seek exemption from court appearance in a real estate trial.
The court found the prescription was prepared with false information, deceiving the doctor who issued it.
Sanka was sentenced to 10 months' rigorous imprisonment and a fine, with Sharma receiving a similar sentence.
The court highlighted the deliberate abuse of the judicial process and the need for strict handling of such instances.

Defense Argument
Authenticity of Prescription
Prosecution Argument
The prescription was forged, Sanka did not visit the hospital, and details were not properly recorded or supported by test reports.
Defense Argument
Arguments focused on lack of jurisdiction, authenticity of electronic evidence, medical protocols during Covid-19, and alleged ulterior motives by the complainant.
Intent and Deception
Prosecution Argument
The accused intentionally deceived the prosecution witness (doctor) and the court to gain an unfair advantage.
Defense Argument
The defense likely argued lack of intent to deceive the court or that the doctor was not truly deceived.
Forgery vs. Cheating
Prosecution Argument
The actions met the criteria for cheating and criminal conspiracy, including destruction of evidence.
