Rajasthan HC Upholds Padmesh Mishra's AAG Appointment
The Rajasthan High Court has decided that the appointment of Padmesh Mishra as an Additional Advocate General is legal.
A lawyer named Sunil Samdaria had argued that Mishra didn't have enough experience and that the government changed the rules just before the appointment to make it possible.
The court said the appointment wasn't illegal or unfair.
The government made a change to the rules that allowed them to appoint someone based on their expertise, not just experience.
Rajasthan High Court upheld Padmesh Mishra's appointment as Additional Advocate General.
Advocate Sunil Samdaria challenged the appointment citing lack of 10 years' experience and improper consultation.
Government amended the Litigation Policy on August 23, 2024, to allow appointments based on expertise.
Court ruled the appointment was not illegal, arbitrary, or unjustified.
Amendment incorporated Clause 14.8, enabling appointments based on expertise.
