Andhra Pradesh HC Ends 20-Year ST Status Battle
A man named Atlapakala Rama Krishna fought a long legal battle for over 20 years to prove that he belongs to the Konda Kapu tribe, which is a Scheduled Tribe (ST) in India.
The government said he didn't have enough proof, but the court ruled that the government should have to prove he doesn't belong to the tribe instead.
The court decided in his favor, saying that children inherit their father's social status.
This means he can now be recognized as a member of the Konda Kapu tribe.
The Andhra Pradesh High Court ruled in favor of Atlapakala Rama Krishna, recognizing his Konda Kapu (ST) status after a 20-year legal battle.
The court emphasized that the burden of proof lies with the authorities disputing the social status, not the individual.
The petitioner's caste certificate was initially rejected in 2005 by the East Godavari district collector and later confirmed by the state Social Welfare Department in 2009.
The court reaffirmed the legal precedent that children inherit their father's social status, supporting the petitioner's claim.
Justice K Sreenivasa Reddy set aside the 2005 and 2009 orders, allowing the writ petition filed by the petitioner in 2009.
