Court Orders Developer to Return Flat to NRI Businessman
A businessman named Suresh Basantani bought a flat in Mumbai in 1997.
He got the keys in 2002, fixed it up, and moved back to the UAE.
When he returned to Mumbai in 2005, he found new people living in his flat.
The developer had sold the flat to them illegally.
The businessman sued the developer in 2010.
The court said the developer must give the flat back to the businessman because the original sale to him was first.
The court also said the sale to the new people was illegal.
The developer has to pay the businessman for the lawsuit.
A civil court ordered Siddhivinayak Builders to return possession of a flat to Suresh Basantani, an NRI businessman.
Basantani purchased the flat in 1997 for Rs 7.76 lakh and received possession in 2002.
Upon returning in 2005, Basantani found the flat occupied by others, who had an illegal sale agreement with the developer.
The court ruled that the original agreement with Basantani was valid and the subsequent sale was illegal.
The developer was directed to pay the lawsuit costs to Basantani.
