MP Court Fines Collector Rs 2 Lakh for Wrongful Detention Under NSA
Imagine a judge saw that a local leader in charge of a town made a big mistake.
This leader put someone in jail for a very long time, but the judge found out the person shouldn't have been jailed like that.
The judge said the leader was very careless and didn't follow the rules, even putting the wrong name on an important paper.
Because of this big mistake, the judge ordered the leader to pay the person who was wrongly jailed a lot of money and to explain why they were so careless.
The judge also said that the law used for putting people in jail for a long time is very serious and should only be used when someone is truly dangerous, not just because it's easy.
The court wants to make sure leaders follow the rules carefully.
The Madhya Pradesh High Court fined Shahdol Collector Dr Kedar Singh Rs 2 lakh for wrongful detention under the NSA.
Contempt proceedings were initiated against the Collector for procedural lapses and filing a misleading affidavit.
Sushant Vaishya was wrongly detained for over a year due to errors in the NSA order, including the mention of another individual's name.
The court found the Collector relied on statements from sand contractor employees and did not examine independent witnesses.
The High Court directed the Chief Secretary to review NSA proceedings and take disciplinary action against implicated officials.
