Missing Statements Led to Acquittal in Malegaon Blast Trial
The court case about the 2008 Malegaon blast had a big problem.
Important papers, like statements from witnesses, went missing.
These missing papers were key to the case, but without them, the court couldn't prove the people accused of the blast were guilty, so they were set free.
The court also wouldn't allow copies of the missing papers to be used.
Because of these problems, there wasn't enough evidence to convict anyone, despite the suspicion surrounding the case.
Thirteen key witness statements went missing during the Malegaon blast trial.
The missing statements were recorded under Section 164 of the CrPC.
The court acquitted all accused due to lack of legal proof.
The Bombay High Court rejected the use of photocopy evidence.
The court noted the prosecution did not examine the magistrates who recorded the statements.
