Punjab and Haryana HC Allows IVF with Donor Eggs
A couple in their late 40s and 50s wanted to have a baby using IVF with donor eggs.
The government said no because the husband was too old and there were other concerns.
But the court said that was not fair and allowed them to try IVF.
The couple had lost their only son and their daughter is married, so they really wanted another child.
The court said the law allows this kind of help, so they should be allowed to try.
Punjab and Haryana High Court allowed a 47-year-old woman and her over 56-year-old husband to use IVF with donor eggs.
The court quashed a state authority order that denied them access to ART on four grounds.
The couple lost their only son to jaundice in July 2024 and their daughter is married.
The woman had reached menopause four years ago, making natural conception impossible.
The court held that none of the grounds for denial were legally sustainable under the ART Act.
