Courts Enhance Compensation for Road Accident Victims
Two Indian High Courts recently made decisions about money given to families of people who died in car accidents.
In Gujarat, the court said that the money given to families should not be seen as a big bonus or prize.
They increased the money from Rs 41.05 lakh to Rs 45.57 lakh but did not include money already paid by a charity.
In Telangana, the court increased the money from Rs 2.51 lakh to Rs 12.44 lakh, saying the earlier amount was too low.
The courts looked at different things like medical bills, loss of income, and the number of people who depended on the person who died.
They also decided on the interest rates for the money.
The courts wanted to make sure the families get fair money for their loss.
Gujarat High Court enhanced compensation from Rs 41.05 lakh to Rs 45.57 lakh for a 2011 road accident victim's family, rejecting inclusion of Rs 10.86 lakh paid by a charitable trust.
Telangana High Court increased compensation from Rs 2.51 lakh to Rs 12.44 lakh for a 2010 road accident victim's family, criticizing the tribunal's conservative award.
Gujarat Court noted that compensation under the Motor Vehicles Act is not a bonus and once expenses are incurred, claimants cannot seek the same amount again.
Telangana Court found the tribunal's assessment of income and impact of death on dependents to be overly conservative, enhancing the award to include future prospects and loss of dependency.
Both courts directed the respective insurance companies to deposit the enhanced amounts within specified timeframes.
