Mumbai Court Discharges Man in Fake Currency Case Due to Prior Conviction
Imagine someone printed fake money.
The police caught them twice, but it was the same crime.
The first time, they were sent to jail in Lucknow.
Later, the police in Mumbai also wanted to punish them.
But the law says you can't be punished for the same crime twice.
Because of this rule, a Mumbai court said they couldn't punish the person again, since they were already in jail for the same thing in Lucknow.
The judge looked at all the evidence and decided that the two cases were about the same fake money and the same crimes, so the person had to be set free in the Mumbai case.
A man was discharged from a Mumbai counterfeit currency case due to a prior conviction in Lucknow.
The Mumbai ATS arrested the man in connection to fake currency found in Mumbai in 2009.
He was previously sentenced to life imprisonment in Lucknow for the same crime in 2011.
The court cited Article 20(2) of the Indian Constitution, which protects against double jeopardy.
The court determined that the offenses in Mumbai and Lucknow were the same, thus he could not be tried again.
