Supreme Court Rules Off-Road Equipment Not Liable for Road Tax
The Supreme Court of India made a big decision about heavy machines used in factories and mines.
These machines, like dumpers and cranes, are mostly used off-road.
The court said that these machines should not have to pay road tax just because they can sometimes move on roads.
The court explained that road tax is only for vehicles that are mainly used on public roads.
However, if these machines are found using public roads, they will have to follow the Motor Vehicles Act and pay the relevant taxes and penalties.
This decision helps many companies that use these machines in their work.
The Supreme Court ruled that specialized off-road machinery used within factory premises, mines, and industrial areas cannot automatically be treated as motor vehicles liable to road tax.
The ruling was in response to a plea by UltraTech Cement Ltd challenging a 2011 Gujarat High Court order that allowed the levy of motor vehicle tax on construction equipment.
The court held that road tax can only be levied on vehicles suitable for use on public roads, as per the Constitution.
The court noted that such equipment is not chargeable to road tax even under the Gujarat Motor Vehicles Tax Act.
The court added that if such machinery is found using public roads, it would attract the provisions of the Motor Vehicles Act and relevant state tax laws.
