Supreme Court Enhances Compensation for 50% Disabled Accident Victim
The Supreme Court increased the money given to a person who was hurt in a car accident and became 50% disabled.
The person was a salesman who was 27 years old.
The court said the High Court made a mistake by lowering the disability percentage from 50% to 40% without a good reason.
The Supreme Court also fixed the person's monthly income at Rs 5,000 and used a special number (17) to calculate the total loss of income, which came to Rs 7.14 lakh.
The court told the insurance company to pay this extra money within three months.
The other parts of the money given for things like pain and suffering were not changed.
The Supreme Court enhanced the compensation for a 50% disabled road accident victim, correcting the High Court's reduction of disability percentage.
The court fixed the claimant's monthly income at Rs 5,000 and applied a multiplier of 17 to calculate the loss of income at Rs 7.14 lakh.
The High Court's decision to reduce the disability from 50% to 40% was disapproved, and the original 50% disability assessment was restored.
The claimant was originally awarded Rs 2.12 lakh by the Tribunal, which was enhanced to Rs 2.23 lakh by the High Court.
The Supreme Court directed the respondent to pay the enhanced compensation within three months.
