Victims Can Appeal Acquittals Directly in Sessions Court
The Punjab and Haryana High Court recently made an important decision about how victims can appeal when someone they accused is found not guilty in court.
Before this, victims had to ask the High Court for special permission to appeal.
But now, the High Court said victims can go directly to the Sessions Court to appeal without needing special permission.
This change happened because the Supreme Court of India said that victims should have the same right to appeal as people who are convicted.
The High Court told the Sessions Court in Fazilka to handle the appeal from a man named Boota Ram, who wants to challenge the acquittal of someone he accused.
The High Court also said that the Sessions Court will decide the case without any influence from the High Court's decision.
This means victims now have an easier way to challenge acquittals in court.
Victims can now appeal acquittals directly in sessions court without needing special leave from the High Court.
The Punjab and Haryana High Court ruled that victims have a statutory right to appeal under Section 372 of the CrPC.
The ruling was based on a recent Supreme Court judgment that clarified the rights of victims to appeal.
The High Court directed the Sessions Judge, Fazilka, to treat Boota Ram’s application as an appeal under Section 372 of the CrPC.
The High Court did not express any opinion on the merits of the case, leaving all issues open for the Sessions Court to decide.
