High Court Overturns Penalty on Gurgaon Developer BPTP
A company in Gurgaon was fined a lot of money for taking water from the ground without permission.
However, the court said the company didn't get a fair chance to defend itself before the fine was given.
The court has ordered the water authority to inspect the construction site again and then decide fairly if a penalty is needed, which is like a do-over.
The company argued it wasn't involved in the initial case and that the water use was temporary.
The court agreed that the rules weren't followed correctly, as the company was added to the case after the penalty was issued, which wasn't fair.
Punjab and Haryana High Court set aside a ₹2 crore environmental compensation imposed on Gurgaon developer BPTP Ltd.
The court found that the Haryana Water Resources Authority (HWRA) violated principles of natural justice.
HWRA is ordered to restart proceedings and conduct a site inspection.
BPTP was not initially a party in the NGT proceedings regarding groundwater violations.
The court referenced a Supreme Court ruling on penalties imposed without proper notice.
