Bombay HC: No NOC Needed for Housing Society Redevelopment
Imagine a group of people in a building who want to fix it up.
Sometimes, they need permission from someone in charge (the registrar).
But a recent court decision said that these groups do not need permission from the registrar to decide to fix up their building.
The court said the registrar's job is to watch the meetings, not to say yes or no to the project.
The court also stopped registrars from asking for money for these permissions, which was happening before.
This means groups can now decide about fixing up their buildings without unnecessary delays or unfair payments.
Bombay High Court ruled against the necessity of a Registrar's NOC for housing society redevelopment.
The ruling clarifies the Registrar's role as supervisory, not adjudicatory.
The decision stems from the case of Baltazar Fernandes & Others v/s DDR, H (West) Ward & Others.
The court found that neither the MCS Act, its Rules, nor the 79A Guidelines require the registrar's NOC.
The court directed against insisting on redevelopment proposals based on NOCs.
