Punjab HC: Parole Time Must Be Deducted From Total Sentence
A court in Punjab made a new rule about how time in prison is calculated for people who get out early.
The court said that when someone is let out on parole (a temporary release from prison), that time should be subtracted from the *total* amount of their sentence, including any time off for good behavior.
The old rule, from the Punjab government, said that parole time should be taken off of the *actual* time spent in prison.
Because of this, someone who had been denied early release had their case reviewed again.
The court said that the parole time should be counted differently, so they could be considered for release.
The Punjab and Haryana High Court ruled parole must be deducted from the total sentence.
The court set aside the Punjab government's 2020 formula.
The HC stated parole's purpose includes reformation and deterrence.
Rupinder Singh's case for premature release was reassessed.
The HC directed that parole be subtracted from the total sentence, not the actual.
