Bombay HC: Auction Buyer Must Clear Previous Owner's Dues for Society Membership
When a flat in a housing society is sold because the owner didn't pay their bills, the new buyer can't join the society until they pay the old owner's debts.
The Bombay High Court said this is fair because the society needs to protect its financial health.
Bombay High Court ruled that an auction purchaser cannot demand membership in a housing society until the previous owner's outstanding dues are cleared
The society had challenged orders directing it to grant membership to the auction purchaser of a defaulting member's flat
The dispute relates to a flat sold under the SARFAESI Act after years of non-payment of maintenance and property taxes
The society refused membership on the 87th day, citing unpaid dues amounting to over Rs 57 lakh
The court upheld the society's refusal, setting aside the orders of the Registrar authorities
