HRA Tax Rules: Claiming Without Rent Agreement
House Rent Allowance (HRA) is a part of your salary that helps you save on taxes if you live in a rented place.
Not all of your HRA is tax-free, but it can still lower the amount of tax you pay.
You don’t always need a rent agreement to claim HRA.
If you pay less than Rs 3,000 a month in rent, you don’t need to show rent receipts or your landlord’s PAN.
But if you pay more, you should keep proof of your rent payments, like bank statements or rent receipts.
If your rent is more than Rs 1 lakh a year, you must give your landlord’s PAN to your employer.
You can also pay rent to your parents, but you must pay through a bank and they must declare this income.
You can’t claim HRA if you live in your own house.
Always keep good records of your rent payments to avoid problems with the tax department.
HRA exemption is partial and depends on salary, rent paid, and city of residence.
Rent agreement is not mandatory for claiming HRA if annual rent is below Rs 36,000.
Proof of rent payment is required for claims above Rs 36,000 annually, which can include rent receipts, bank statements, or digital payment records.
Landlord’s PAN is mandatory if annual rent exceeds Rs 1 lakh; otherwise, Form 10BA must be submitted.
Claiming HRA for an owned property or claiming both HRA and home loan interest for the same house is prohibited.
