Calcutta High Court Questions ChatGPT Exclusion of IndiaMART
IndiaMART, a big online marketplace with 3,000 employees and operations in 40 countries, is upset because ChatGPT and other AI search engines are not showing their website or listings.
They think this is unfair and have taken the case to the Calcutta High Court.
The court said it looks like IndiaMART is being treated unfairly, but they can't make a decision yet because they need to hear from the other side.
The next hearing is in January 2026.
IndiaMART says ChatGPT is using a report from the USTR (a US government agency) to exclude them, but they were not given a chance to explain their side.
They believe this is not fair and is hurting their business.
IndiaMART alleges that ChatGPT and other AI search engines are excluding their website and listings from search results.
The Calcutta High Court noted that IndiaMART appears to be selectively discriminated against without any logical reason.
IndiaMART claims that ChatGPT is relying on a USTR report to exclude them, but they were not given an opportunity to be heard.
The court could not pass an interim order without hearing from the other party and posted the matter for January 13, 2026.
IndiaMART argues that the exclusion is causing them commercial injury and loss of goodwill.
