Delhi Woman Wins Rs 11.65 Lakh After Theft Claim Rejected
A woman in Delhi bought a Toyota Fortuner and it was stolen before the insurance policy was officially transferred to her name.
The insurance company said the claim was invalid because the policy was still in the previous owner's name.
The Delhi consumer commission looked at the case and said the insurer was wrong.
They ordered the insurer to pay the woman Rs 11.65 lakh, plus interest, and also give her Rs 30,000 for the trouble she went through.
The insurer also has to pay Rs 10,000 for her legal costs.
The case shows that when you buy a car, you must transfer the insurance policy within 14 days, or the insurer can reject a claim.
Delhi consumer commission ruled insurer must pay Rs 11.65 lakh plus interest for denied claim.
Claim was rejected because insurer said policy was not transferred to new owner after sale.
Toyota Fortuner was stolen on August 10, 2022, before policy transfer was completed.
Commission awarded Rs 30,000 compensation and Rs 10,000 litigation costs to the owner.
Policy must be updated within 14 days of ownership change under the Motor Vehicles Act.
