ED Retreats After Legal Community Condemns Advocate Summons
The Enforcement Directorate (ED), a government agency, initially questioned lawyers about their clients' cases, sparking worry among lawyers who feared it could break the rules of protecting the communications between a lawyer and client.
After pushback from the legal community, the ED has changed its approach.
They withdrew a summons to one lawyer and issued new rules that investigators need permission from the director before questioning lawyers.
The lawyers groups said that the initial actions could hurt lawyers' ability to work independently and fairly for their clients.
ED issued summons to Senior Advocates Datar and Venugopal regarding legal advice given to Care Health Insurance Ltd.
Legal fraternity raised concerns over the summons, citing potential violations of attorney-client privilege.
ED clarified that summons to Venugopal has been withdrawn.
ED issued a circular instructing field formations not to issue summons to any advocate in violation of Section 132 of the Bhartiya Sakshya Adhiniyam, 2023.
Supreme Court Bar Association condemned ED's actions, saying it undermines the independence of the Bar.
