Allahabad HC Bars Govt. Delay Concession in Arbitration
Govt cannot seek delay condonation citing red tape in arbitration cases: Allahabad HC · theprint.in

The Allahabad High Court decided that the government cannot get a special pass to file a legal appeal late just because it had paperwork delays.

A company called Gallant Ispat had won an arbitration case against the Ministry of Railways and the ministry tried to challenge the award, but it was too late.

The court said the ministry had to give a good reason for the delay, not just say it was a bureaucratic problem.

The court followed the Supreme Court’s rule that delay relief is an exception, not a rule.

So the ministry’s appeal was dismissed and the company keeps its award.

This means the government must follow the same time limits as private parties in legal cases.
