Madras HC Asks Tamil Nadu on Transgender/Intersex Reservation
The Madras High Court is asking the Tamil Nadu government to decide if it will give special job and school spots (reservations) to transgender and intersex people.
The court is happy the state made a new policy, but wants to make sure it's fair.
The court wants trans and intersex people on the committees that run the policy and is also suggesting that the state should help transgender and intersex couples with marriage registration and maybe create a way to recognize unmarried partnerships.
The court also wants the government to consider renaming the policy to include both transgender and intersex people.
Madras High Court urged Tamil Nadu to clarify its stance on providing horizontal reservations for transgender and intersex individuals.
The court welcomed the state's efforts to codify rights but emphasized the need for inclusive implementation mechanisms.
The court directed the government to include trans women, trans men, and intersex persons in district and state-level committees.
The court addressed practical challenges faced by transgender and intersex couples in marriage registration.
The court suggested considering non-marital partnerships through legal instruments and renaming the policy.
