BCA Assures Gujarat HC on Candidate's Nomination
Dr Darshan Banker wanted to be the president of the Baroda Cricket Association, but he couldn't be there when they checked his papers because he was at his son's wedding.
The cricket association said they wouldn't reject his papers just because he wasn't there.
The court said the cricket association should be fair and let someone represent Banker.
The cricket association was worried that if they let Banker off, others might also ask for special treatment.
The court told them to let Banker send someone to check the papers instead.
BCA assured the Gujarat High Court that Dr Darshan Banker's nomination will not be rejected for his absence during scrutiny.
Banker's absence was due to his son's destination wedding in Goa on the same day.
The court allowed Banker to send a representative for the scrutiny of nomination forms.
BCA argued that the clause requiring candidate presence was not a departure from previous years' practices.
The court questioned the necessity of the candidate's presence and emphasized the importance of a fair and democratic election process.
