Delhi High Court Quashes CISF Officer's Dismissal
The Delhi High Court recently made a big decision.
They said that a CISF constable, who was fired for some reasons, should not have been fired.
The court looked at the evidence, which included a short video and some statements, and said it wasn't enough to prove the constable did something wrong.
They also said that having a mobile phone while on duty isn't a very serious rule if you have permission.
The court decided that the constable should get his pension and other benefits, even though he can't get his job back because he has already retired.
They said all this should happen within 8 weeks.
The Delhi High Court quashed the dismissal order of a CISF constable accused of assaulting superior officers.
The court found the evidence, including a selective video recording and statements of interested witnesses, insufficient to prove the incident.
Possession of a mobile phone while on duty is not an absolute prohibition and is subject to approval by a senior officer.
The court emphasized that the forfeiture of pension and other retirement benefits would be a travesty of justice.
The constable will receive his pensionary and other retiral benefits as per the date of superannuation within 8 weeks.
