NCLAT Overturns Audit Order for Golden Tobacco, Extends CIRP Timeline
Imagine a company called Golden Tobacco is having financial trouble, and a court is trying to help it out.
Another court, NCLAT, looked at what the first court, NCLT, was doing and made some changes.
NCLAT stopped the first court from doing a special financial checkup and from changing the person in charge of the company's recovery plan.
NCLAT also gave Golden Tobacco more time to sort things out and told the first court to sort out who owes what money before deciding what to do next.
Some companies who wanted to be paid back also had their cases decided by the NCLAT.
NCLAT set aside the NCLT's direction for a forensic audit of Golden Tobacco.
NCLAT also reversed the NCLT's decision to replace the resolution professional.
The timeline for completing the CIRP for Golden Tobacco has been extended to October 17, 2025.
NCLAT directed the NCLT to decide on the claims of financial creditors and reconstitute the Committee of Creditors (CoC).
The appellate tribunal dismissed petitions from Suraksha Realty and Sheth Developers regarding their financial creditor status.
