Telangana HC Rules Against APIDC's Promotion Policy
A judge in the Telangana High Court said that a company called APIDC was being unfair in promoting employees.
The judge said that a senior employee, Mr. Balaraju, should not have been passed over for promotion to a higher position just because he didn't meet some strict marks set by the company.
The judge explained that for certain jobs, seniority should be the most important factor, and the company's way of doing things was not right.
The judge also said that the company cannot make up new rules that are not allowed by law.
Telangana High Court disapproved of APIDC's 'pick-and-choose' promotion policy.
Justice Nagesh Bheemapaka ruled that a junior employee cannot supersede seniors in promotions for non-selection posts.
Attelli Balaraju, a senior employee, was overlooked for promotion to Deputy Manager in 1999 and 2007.
APIDC argued that promotions were based on seniority-cum-merit and that Balaraju did not meet benchmark marks.
The court held that APIDC's introduction of rigid cut-off marks was arbitrary and constitutionally impermissible.
