Thane Tribunal Awards Rs 30 Lakh Compensation to Family of Man Killed by Reversing Bus
A special court in Thane has ordered an insurance company to pay a family about 30 lakh rupees.
This is because their husband and father, who worked as an IT consultant, was sadly killed when a bus reversed into him in 2020.
The man was waiting at a bus stop when the bus driver suddenly reversed too fast and hit him.
The court decided it was the bus driver's fault because he was driving carelessly.
The bus company's insurance company tried to say the driver wasn't allowed to drive that bus because of his license.
However, the court checked the rules and said the driver's license was actually valid for that type of bus.
So, the insurance company has to pay the money to the family, and a good part of it will be invested to help them in the future.
The Motor Accident Claims Tribunal (MACT) in Thane awarded Rs 30.11 lakh compensation to the family of an IT consultant.
The victim, Dinesh Yashwant Khot, was killed in 2020 after being struck by a reversing bus while standing at a bus stop.
The tribunal found the accident was due to the sole negligence of the bus driver, who reversed the vehicle rashly and negligently.
The insurer's argument that the driver's LMV license was insufficient for the bus was rejected by the tribunal.
The bus owner and its insurer were held jointly and severally liable to pay the compensation, with a portion to be invested for the family's long-term security.

Driver's License Validity
Insurer's Argument
The insurer argued that the bus driver only possessed an LMV (Light Motor Vehicle) license, which they claimed was insufficient for driving a mini-bus/heavy vehicle. They believed this constituted a breach of the insurance policy conditions.
Tribunal's Rejection
The tribunal rejected this, interpreting the Motor Vehicles Act to mean that an LMV license, particularly for LMV Transport Class, covers transport vehicles under 7,500 kg unladen weight. Therefore, no separate endorsement was needed, and there was no willful breach of policy terms.
