SC deletes part of Kerala HC order on Waqf Board
The Supreme Court recently changed a decision made by the Kerala High Court.
The High Court had said that the Kerala Waqf Board, which manages certain properties and funds for the Muslim community, had to be supervised by a government official and couldn't make big decisions without the court's permission.
The Supreme Court said that this supervision was not necessary and removed that part of the order.
However, the government official can still be a member of the Board.
The Supreme Court also asked the High Court to quickly decide the case after giving both sides a chance to present their arguments.
This change was made because the Supreme Court felt that the Board should be able to function normally and not be held back by issues related to its membership.
The Supreme Court deleted part of a Kerala High Court order that required the Waqf Board to function under the supervision of a joint secretary.
The High Court had restrained the Waqf Board from taking major decisions without court permission.
The Supreme Court restored the Board's autonomy, allowing it to function independently.
The joint secretary can continue to be a member of the Board but not in a supervisory capacity.
The Supreme Court asked the High Court to expedite the decision-making process in the case.
