GST Law Committee Proposes Higher Prosecution Threshold, Shorter Jail Terms

GST Law Committee Proposes Higher Prosecution Threshold, Shorter Jail Terms

A committee that advises India’s GST Council has suggested changes to the rules for GST crimes.

It wants the amount needed for prosecution to rise from ₹5 crore to ₹10 crore.

It also suggests a maximum two-year jail term for tax evasion between ₹5 crore and ₹10 crore, instead of three years.

The committee wants judges to be able to choose jail, a fine, or both, depending on how serious an offence is.

But members did not agree on whether GST officials should keep the power to arrest people.

Some think better checks on tax returns could reduce fraud and make arrests unnecessary.

Others say arrests can help enforce the law in serious cases, as long as safeguards prevent misuse.

The GST Council is expected to consider the proposals on October 7.
