SC Judge Calls for Strong Arbitral Institutions
A Supreme Court judge, Justice Rajesh Bindal, recently spoke at a conference about the need for strong institutions to solve disputes in the infrastructure sector, which includes things like roads, power, and dams.
He said that as India builds more infrastructure, there will be more disputes, and these should be solved quickly to avoid delaying projects.
He suggested using institutional arbitration, which involves experts and better management to make the process faster and cheaper.
He also warned about the problems that Artificial Intelligence (AI) can cause in legal cases, like fake evidence and judgments.
Other speakers, including the Attorney General, agreed that there is a need for better laws and education in construction law to handle these issues effectively.
Justice Rajesh Bindal emphasized the need for strong arbitral institutions to handle disputes in India's booming infrastructure sector.
He endorsed institutional arbitration to combat issues of inflated costs and delayed proceedings in construction disputes.
Bindal warned about the challenges posed by AI in arbitration and litigation, including fabricated evidence and confidentiality risks.
Attorney General R Venkataramani called for dedicated legislation for the construction sector to address its fragmented nature.
Lalit Bhasin, president of the Society of Indian Law Firms, highlighted the weaknesses in the current system and stressed the need for strong arbitral institutions.
