Chief Justice Emphasizes Legal Aid as Moral Duty, Proposes Institutional Reforms
Imagine a special club that helps people who can't afford a lawyer get legal help.
The head judge, Chief Justice Gavai, said this help isn't just a nice thing to do, like giving a gift.
It's a very important job that the government must do to make sure everyone, even the poorest people, gets fair treatment under the law.
He said this is like a 'moral duty' for everyone involved.
Another important judge, Justice Kant, agreed and said this help needs to be strong and caring.
The Chief Justice also pointed out that sometimes, when new people take charge of this club, their new ideas don't always get finished because they leave.
So, he suggested creating a special team with past and future leaders to make sure the good plans for helping people keep going for a long, long time.
He also told judges who help with this that they need to be kind and listen to people's problems, not just follow strict rules, to truly help those who have been left out.
Chief Justice of India B R Gavai stated that legal aid is a moral duty and an exercise in governance, not merely charity.
Justice Surya Kant highlighted 'access to justice' as a vital right requiring continuous nurturing through institutional strength and professional competence.
CJI Gavai proposed creating an Advisory Committee at NALSA and State Legal Services Authorities to ensure continuity and long-term vision for legal aid programs.
The committee would comprise current and future Executive Chairpersons to oversee projects and ensure consistency despite administrative changes.
Judicial officers involved in legal aid were advised to prioritize empathy, collaboration, and understanding of societal conditions over strict procedural adherence.
