DoT Seeks Legal Opinion on Supreme Court Ruling for Vodafone Idea's AGR Dues
Imagine Vodafone Idea (Vi) owes a lot of money to the government for using airwaves, called AGR dues.
Vi asked the Supreme Court if they could re-examine these dues because they thought a past demand was unfair.
The Supreme Court said that while they wouldn't stop the government from looking at it again, they only meant for the government to consider a specific part of the debt, about ₹9,449 crore from a long time ago.
This is confusing because Vi owes much more money overall.
Now, the government's telecom department needs to get legal advice to understand if they can actually help Vi and how much, especially since Vi is important for many phone users and the government even owns some of Vi.
The Department of Telecommunications (DoT) will seek legal opinion on the Supreme Court's recent order concerning Vodafone Idea's (Vi) AGR dues.
The Supreme Court's ruling allows the government to potentially revisit Vi's AGR dues, especially a specific demand of ₹9,449 crore for the period up to FY 2016-17.
However, the court's order is confined to Vi's plea on this additional demand and does not extend to Vi's broader AGR liabilities, which are significantly higher.
This nuanced judgment creates ambiguity regarding the extent to which the government can exercise policy discretion for relief.
Vi's overall AGR liabilities were initially set at over ₹58,000 crore, escalating to approximately ₹83,400 crore with interest and penalties.
