ITAT Mumbai Rules Individual Homeowners Liable for Capital Gains in Redevelopment
Imagine you live in a building with your neighbors, and your building is old.
You all agree to let a builder make a new, nicer building.
The builder gives you new apartments and maybe some money.
Your housing society helped make the deal happen, but you and your neighbors are the real owners of the land.
The tax office thought the housing society should pay tax on the new apartments or money, but a special tax court said, 'No, the people who got the new apartments or money are the ones who need to pay tax on it.'
This is because they are the actual owners.
If you sell your new apartment later and make money, that money is what gets taxed, and you might even get a break on the tax if you follow certain rules.
The court also said the housing society shouldn't be fined because it was just helping out.
The ITAT Mumbai ruled that individual homeowners are liable for capital gains tax on redevelopment projects, not the cooperative society.
The decision was made in a case involving the RBI Employees Bhagvati Co-operative Housing Society Ltd.
The tribunal found that homeowners, not the society, are the beneficial owners of the property and any consideration received.
Monetary compensation, rent reimbursement, or extra built-up area received by members is taxable under Capital Gains.
The ITAT upheld the deletion of a penalty previously levied on the cooperative society.
