Uttarakhand High Court Raises Maintenance, Rejects Voluntary Savings Argument

Uttarakhand High Court Raises Maintenance, Rejects Voluntary Savings Argument

A court in Uttarakhand decided that a mother and her young child should receive more money each month from the child's father.

The amount was raised from Rs 12,000 to Rs 25,000.

The husband is an Army sepoy, and his gross salary was reported as Rs 88,588 per month.

The mother said she had no job or independent income.

She also had to pay for food, clothing, medical care, and the child's schooling.

The husband said his usable salary was lower because he chose savings and post-retirement plans.

The court said people cannot use voluntary savings deductions to avoid supporting their spouse and child.

It said maintenance should help them live with reasonable dignity, not merely survive.
