Deceased Taxpayer’s Notice: Legal Heir Duties and Liability

A tax notice can still matter even if the person named in it has died.

The family member handling the matter should tell the Income Tax Department about the death.

They should provide the death certificate and proof that they are the legal heir.

They should also register on the tax website as the deceased person’s representative.

Older tax cases may continue, but a new case usually needs a new notice addressed to the heir.

Ignoring the notice could lead to a tax bill, interest or penalties.

Usually, the tax is paid from the property and money left by the deceased.

However, an heir could become personally responsible if they give away estate property before paying the tax.

Income earned before death belongs in the deceased person’s final return, while later income from inherited assets belongs in the heir’s return.
