Orissa High Court Upholds Natural Justice Principles
The Orissa High Court recently emphasized the importance of natural justice principles.
The court noted that even God gave Adam and Eve a chance to explain themselves after they ate the forbidden apple.
The court was hearing a case where some people were unhappy about an order that took away one of their yearly pay increases.
The petitioners' lawyers argued that this pay increase is like property and should not be taken away without proper notice.
The state's lawyer said that giving notice would not change anything.
The court agreed that any order made without following the principles of natural justice is not valid.
So, the court sent the case back to the District Education Officer to be reconsidered, making sure that everyone involved, including the petitioners, gets a chance to be heard.
Orissa High Court emphasized the principles of natural justice, comparing it to God giving Adam and Eve a chance to explain themselves.
The petitioners challenged a recovery order due to the withdrawal of one annual increment, arguing it constitutes property under Article 300A of the Constitution.
The state's counsel argued that giving notice would not serve any useful purpose and that the principles of natural justice do not apply.
The court found that an order without compliance with natural justice principles is unsustainable and remitted the matter back to the District Education Officer for reconsideration.
The court ordered that the matter be reconsidered after giving an opportunity of hearing to all stakeholders, including the petitioners.
