New Rental Laws: Security Deposit Limits and Entry Rules
The new rental laws in India, based on the Model Tenancy Act, 2021, have several important changes.
Tenants now have to pay a security deposit of only two months' rent for residential properties and six months' rent for non-residential properties.
Landlords must give tenants a 24-hour notice before entering the property for repairs or inspections.
Both landlords and tenants must report their rental agreement to the District Rent Authority within two months.
The laws also specify who is responsible for repairs and maintenance.
Several states, including Maharashtra and Karnataka, have adopted these new rules.
These changes aim to make renting fairer and more formal for both landlords and tenants.
Security deposit for residential properties is capped at two months’ rent, and six months’ rent for non-residential properties.
Landlords must provide 24-hour written notice before entering the rented property for inspections or repairs.
Tenancy agreements must be digitally stamped, registered online, and reported to the District Rent Authority within two months.
Tenants are responsible for periodic repairs, while landlords handle structural repairs and major maintenance.
States like Maharashtra and Karnataka have recently implemented these new rental laws based on the Model Tenancy Act.
